General terms and conditions of the Sagittamed Shop
1. Contractual partner and validity of the general terms and conditions of the Sagittamed Shop: Your contractual partner is Sagitta GmbH, Nonnenstrasse 8, 85614 Kirchseeon (hereinafter Sagitta). Sagitta operates the Sagittamed Shop at www.sagittamed.de. These General Terms and Conditions apply exclusively to all purchases in the Sagittamed Shop. The customer's terms and conditions do not apply.g.
2. Contract languages: The contract language is German.
3. Conclusion of contract: The offers in the Sagitta Shop represent a non-binding invitation to order goods. By ordering the goods by clicking the Buy Now button, you are making a binding offer to purchase the goods in your shopping cart. We will inform you immediately by email that we have received your order and will also confirm the conclusion of the contract in the same email.n.
4. Delivery area and delivery date: Sagitta sends all deliveries to customers residing in Germany as well
- in the EU Zone 1 (Austria, Belgium, Denmark, Luxembourg, Netherlands, Czech Republic, Poland),
- in the EU Zone 2 (France, Finland, Hungary, Ireland, Italy, Portugal, Spain, Sweden),
- in the EU Zone 3 (Switzerland, Liechtenstein, Bulgaria, Croatia, Estonia, Greece, Latvia, Lithuania, Romania, Slovakia, Slovenia, United Kingdom).
Deliveries within Germany and the EU take place within one (1) week after conclusion of the contract. The shipping costs are
- for Germany Euro 4.50,
- to the EU Zone 1: Euro 9.50
- to the EU Zone 2: Euro 12.50
- to the EU Zone 3: Euro 14.50.
From an order volume of Euro 50.00, shipping is free for the customer in Germany, from Euro 75.00 to EU zones 1 and 2, from Euro 100.00 to EU zone 3.
For orders from other countries, Sagitta asks customers to contact Sagitta individually at the email address info@sagittamed.de.
5. Prices and invoice: Sagitta's prices are in euros and include statutory sales tax. By providing your email address as part of the order or when creating your customer account, you agree that Sagitta will send you the invoice by email.

You have the right to cancel this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

Consequences of revocation
If you cancel the contract, we will have to pay you all payments we have received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment.
We may refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is the earlier.
You must return or hand over the goods to us (Sagitta GmbH, Nonnenstrasse 8, 85614 Kirchseeon) immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.
You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Exclusion of the right of withdrawal: The right of withdrawal does not apply
- Contracts for the delivery of goods that can spoil quickly or whose expiry date would quickly be exceeded;
- Contracts for the supply of sealed goods which are not suitable for return for health or hygiene reasons if their seal has been removed after delivery.
10. Defects: Sagitta's goods are subject to statutory liability for defects.

Liability: Sagitta is liable without limitation for statutory liability regardless of fault (e.g. from a guarantee or under the Product Liability Act), as well as for personal injuries (injury to life, body, health). Sagitta also has unlimited liability for intent and gross negligence. In the case of slight negligence, Sagitta is only liable for the breach of cardinal obligations. Cardinal obligations are those obligations that are to be granted to you in accordance with the meaning and purpose of the specific contract or whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance you can regularly rely. In these cases, however, Sagitta is not liable for indirect or unforeseeable damages, for consequential damages, for lost profits or for missed savings. Furthermore, Sagitta's liability is excluded in the event of slight negligence. This limitation of liability also applies to Sagitta's legal representatives, employees, salaried employees and vicarious agents.
12. Contract text: The contract text will not be saved for you by Sagitta and will no longer be available to you on the Sagitta website after the contract has been concluded. When concluding a contract, you have the option of accessing and saving the contractual terms and conditions, including these General Terms and Conditions.
13. Complaints: Sagitta is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board in accordance with the Consumer Dispute Settlement Act (VSGB).
